1. Introduction
At Cyberix, we understand that custom-assembled computer systems are expected to deliver strong performance, long-term reliability, and dependable support. To reflect our confidence in the quality of our workmanship, Cyberix offers a Limited Lifetime Warranty on eligible custom-assembled systems purchased directly from Cyberix.
This warranty explains the coverage, conditions, limitations, exclusions, and responsibilities that apply to Cyberix and the original purchaser.
This Limited Lifetime Warranty only applies when it is either included in writing with the purchase or purchased separately as a warranty upgrade. It is not automatically included with all orders, promotions, giveaways, contests, discounts, or special campaigns.
2. Warranty Eligibility
The Limited Lifetime Warranty applies only to eligible custom-assembled Cyberix systems purchased directly from Cyberix.
For regular purchases, warranty eligibility will be determined based on the product listing, checkout details, invoice, or written confirmation provided by Cyberix.
For promotional offers, discounted orders, giveaways, contests, prize orders, or special campaigns, the Limited Lifetime Warranty must be purchased separately unless Cyberix clearly states in writing that the warranty is included.
If the Limited Lifetime Warranty is not purchased separately or expressly included in writing, the product may only be covered by the applicable standard warranty, manufacturer warranty, or any mandatory consumer protection rights required by law.
Cyberix reserves the right to verify warranty eligibility using the original order details, invoice, promotion terms, giveaway rules, checkout records, and proof of warranty purchase.
3. Warranty Period
For the purposes of this Limited Lifetime Warranty, “Lifetime” refers to the standard usable operational life expectancy of the product under normal consumer use and environmental conditions.
Unless otherwise stated in writing, the lifetime warranty period is defined as five (5) years from the original date of delivery or pickup.
The warranty period begins on the original delivery date or pickup date shown on the proof of purchase.
4. Warranty Coverage
a. Covered Defects
During the warranty period, Cyberix will repair or replace eligible systems or components that are found to have defects in materials, assembly, or workmanship under normal use conditions.
Labor for approved warranty repairs is covered at no additional charge during the applicable warranty period.
b. Repair or Replacement
Cyberix reserves the right, at its sole discretion, to:
- Repair the affected system using new, refurbished, or functionally equivalent components.
- Replace the affected system with a new, refurbished, or equivalent-performance custom-assembled computer.
- Replace discontinued or unavailable components with comparable alternatives of equal or greater functionality.
Replacement parts or systems may differ from the original product in brand, model, appearance, color, or configuration, provided that the replacement maintains equivalent operational performance.
5. Exclusions
This warranty does not cover the following:
a. Misuse, Abuse, or Unauthorized Modifications
This warranty does not cover damage caused by misuse, abuse, neglect, improper handling, improper installation, unauthorized repairs, unauthorized modifications, or use outside the product’s intended purpose.
This includes, but is not limited to, damage caused by unsupported overclocking, improper voltage settings, physical damage, liquid exposure, or modifications not approved by Cyberix.
b. External Causes
This warranty does not cover damage caused by events or conditions outside Cyberix’s reasonable control, including but not limited to:
- Accidents.
- Theft.
- Fire.
- Flood.
- Earthquakes.
- Lightning.
- Power surges.
- Natural disasters.
- War.
- Civil unrest.
- Shipping damage caused by improper packaging.
- Any other external cause not related to Cyberix workmanship.
c. Cosmetic Damage
This warranty does not cover normal wear and tear or cosmetic imperfections that do not affect the functionality of the system.
This includes scratches, dents, discoloration, fading, scuffs, marks, or other superficial damage.
d. Software Issues
This warranty does not cover software-related problems, including but not limited to:
- Operating system corruption.
- Malware or virus infections.
- Driver conflicts.
- Third-party software incompatibility.
- Failed software updates.
- Data loss.
- Data recovery.
- User-installed software errors.
Customers are responsible for maintaining backups of their personal files and data.
e. Consumables, Accessories, and Peripherals
This warranty does not cover consumable items, accessories, or external peripherals unless expressly stated in writing.
Excluded items may include:
- Batteries.
- Cables.
- External adapters.
- Headsets.
- Keyboards.
- Mice.
- Monitors.
- Speakers.
- External accessories.
- Any other peripheral not specifically covered by Cyberix.
Manufacturer warranties may still apply to certain accessories or third-party components.
f. Non-Cyberix Products
This warranty does not cover any computer, component, accessory, or product that was not assembled and sold directly by Cyberix.
Systems modified, rebuilt, or repaired by third parties may lose eligibility for warranty coverage if the issue is related to such modification, repair, or alteration.
g. Commercial, Industrial, or Abusive Use
This warranty does not cover systems used in environments or workloads beyond normal consumer or professional desktop use.
Excluded uses may include, but are not limited to:
- Abusive cryptocurrency mining.
- Unauthorized server use.
- Industrial deployment.
- Extreme thermal environments.
- Heavy continuous workloads not disclosed to or approved by Cyberix.
- Any use that exceeds the intended operating conditions of the system.
Commercial or specialized use may require separate written approval from Cyberix.
6. Warranty Claims
a. Proof of Purchase
Customers must provide the original invoice, order confirmation, or valid proof of purchase when requesting warranty service.
Cyberix may also request proof that the Limited Lifetime Warranty was purchased separately or included in writing, especially for promotional, discounted, giveaway, contest, or prize-related orders.
b. Product Registration
Where applicable, customers may be required to register their product through Cyberix’s official website within thirty (30) days of purchase to help verify warranty eligibility and support service.
Failure to register does not automatically void any statutory consumer rights where such rights are protected by applicable law.
c. Diagnostic Procedures
Before approving a warranty claim, Cyberix may ask the customer to perform reasonable troubleshooting or diagnostic steps.
This may include providing photos, videos, error messages, system logs, component information, or other details needed to evaluate the issue.
Failure to cooperate with reasonable diagnostic procedures may delay or limit warranty service.
d. Shipping Responsibilities
Unless Cyberix states otherwise in writing, the customer is responsible for:
- Shipping costs to the service center.
- Transportation costs.
- Import or export duties.
- Customs fees.
- Proper packaging.
- Shipment insurance.
Cyberix is not responsible for damage caused during shipping due to inadequate or improper packaging by the sender.
Customers should package systems securely and remove any loose items before shipment.
7. Data Responsibility
Customers are solely responsible for backing up all personal data before sending any system, component, or storage device for service.
Cyberix is not responsible for lost, damaged, deleted, or corrupted data during inspection, repair, replacement, or servicing.
Warranty service may require the replacement or reformatting of storage devices, which may result in permanent data loss.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Cyberix’s liability under this warranty is limited solely to the repair, replacement, or reimbursement of the defective product or component.
Cyberix shall not be liable for indirect, incidental, consequential, punitive, or special damages, including but not limited to:
- Loss of data.
- Loss of business.
- Loss of profits.
- Loss of revenue.
- Downtime.
- Loss of use.
- Third-party claims.
- Missed opportunities.
- Costs related to substitute equipment or services.
The remedies provided under this warranty are the customer’s exclusive remedies, except where prohibited by applicable law.
9. Transferability
This warranty is provided exclusively to the original purchaser and is non-transferable unless otherwise required by applicable local consumer protection laws.
If the system is sold, gifted, transferred, or otherwise provided to another person, warranty coverage may no longer apply unless Cyberix confirms otherwise in writing.
10. Amendments and Policy Updates
Cyberix reserves the right to modify, update, renew, suspend, or terminate this warranty policy at its discretion.
Any changes to this warranty policy will apply prospectively and will not retroactively reduce warranty coverage for products already sold and covered under a valid warranty policy, unless required by law.
Updated warranty terms may be published on Cyberix’s official website or communicated through other official Cyberix channels.
11. Governing Law
This warranty policy shall be governed and interpreted in accordance with the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles.
For international customers, mandatory consumer protection rights applicable in the customer’s country or jurisdiction of residence may also apply to the extent required by local law.
12. Legal Rights
This Limited Lifetime Warranty provides specific warranty benefits offered by Cyberix. It does not replace, limit, or exclude any mandatory rights that customers may have under applicable consumer protection laws.
Where any part of this warranty conflicts with mandatory local law, the applicable legal requirement will prevail only to the extent necessary.
